Seeking Guardianship and Conservatorship Over a Loved One

There are several conditions that can cause adults to lose the mental or physical capacity to care for themselves. Once this happens, the affected person may be vulnerable to abuse and other dangerous situations. Common conditions include:

When an adult becomes incapacitated, the courts are authorized to appoint a guardian to take care of the person's physical needs and, if needed, a conservator to manage his or her finances and property.


There are constitutional and procedural protections designed to ensure that the person really needs supervision and that the person requesting appointment is the right person to take on that responsibility. For instance, the court will appoint a separate attorney to represent the allegedly incapacitated person.
